What is a lis pendens?
Lis pendens means “suit pending”. It’s a document that’s recorded at the beginning of a lawsuit stating that a particular piece of property is impacted or affected by this lawsuit. Again, it’s recorded at the beginning of the lawsuit, and it’s regulated by Florida Statutes 48.23.
The Florida Statutes are quite clear on what needs to be included in a lis pendens, and it notifies the world that that particular piece of property (most often real property) is or may be affected by the suit. It puts others on notice that there’s litigation in connection with the property.
