What is a Notice to Owner (NTO)?
A Notice to Owner is a notice to the owner that if a subcontractor on the job is not paid, then that subcontractor can lien the property. There’s a warning at the top which basically says you could have to pay twice, as the owner, if you don’t get releases from the subs. Subs can be materialmen or suppliers, or those subs providing services or rental equipment. A Notice to Owner has to be served by those who are not in privity with the owner within 45 days of first being on the job.
