A partition lawsuit is a suit usually involving real property in Florida where the owners of the property are in dispute and the Court is being asked to divide the property up. If the property is not divisible in an equitable way, then the Court can set that property for a public auction.

In Florida there’s a particular statute for partition. A partition could involve personal property as long as that personal property is something that can be divided and done so in an equitable way.
